As part of any recruitment process, Hauser & Wirth AG, Limmatstrasse 270, 8005 Zurich, Switzerland (“Hauser & Wirth” or “we”) collects and processes personal data relating to job applicants. We are committed to being transparent about how we collect and use that data and to meeting our data protection obligations.
Who is responsible for data processing?
Hauser & Wirth will function as the “controller” within the meaning of Art. 4 number 7 of Regulation (EU) 2016/679, also known as the “General Data Protection Regulation” (“GDPR”).

Which personal data is processed by us and for which purposes?
We process your personal data that you have sent us in connection with your application in order to check your suitability for the position (or other open positions in our company, if applicable) and to carry out the application process. This includes in particular your cover letter, curriculum vitae, your name, address and contact details, including personal email address and mobile telephone number, certificates, applicant questionnaires, applicant interviews, information about your current level of remuneration, including benefit entitlements; etc. (“Personal Data”). We would like to evaluate all applicants only according to their qualifications and ask them to refrain from disclosing “special categories of data” according to Art. 9 GDPR, which may only be processed with your consent.
What is the legal basis for data processing?
Legal basis for the processing of your Personal Data in the application procedure are Art. 6 para. 1 sentence 1 lit. b) and Art. 6 para. 1 sentence 1 lit. f) GDPR. Accordingly, we will process your Personal Data particularly to perform pre-contractual measures when data are required in connection with the decision to establish an employment relationship or to safeguard legitimate interests.
Hauser & Wirth has a legitimate interest in processing Personal Data during the recruitment process and for keeping records of the process. Processing Personal Data from job applicants allows Hauser & Wirth to manage the recruitment process, assess and confirm a candidate’s suitability for employment and decide to whom to offer a job. Our interest may further consist in the defence or assertion of claims.
To which recipients will your Personal Data be forwarded?
We may share your information with our affiliates including Hauser & Wirth Menorca SL, Hauser & Wirth Gallery Ltd., Hauser & Wirth Inc., Hauser & Wirth CA Inc., Hauser & Wirth Limited insofar as this is necessary to safeguard our legitimate interests within the meaning of Art. 6 para. 1 sentence 1 lit. 1 f GDPR. Within the company, your Personal Data may be passed on due to our legitimate interests, in particular for the evaluation of applications by the respective department managers, the respective department as well as by the management and other bodies of Hauser & Wirth. This includes HR, interviewers involved in the recruitment process, managers in the business area with a vacancy and IT staff if access to the Personal Data is necessary for the performance of their roles.
Furthermore, we may pass on your Personal Data to third parties if this is necessary in connection with the decision on the establishment of the employment relationship. Hauser & Wirth will for example share your Personal Data with former employers to obtain references for you.
Where is your Personal Data processed?
If we transfer Personal Data to our affiliated companies in countries outside the European Economic Area, we ensure that the recipient of the Personal Data guarantees an appropriate level of data protection in the sense of Art. 45 GDPR. In the absence of a resolution on adequacy, we oblige our affiliated companies through binding internal data protection regulations in accordance with Art. 47 in conjunction with Art. 46 para. 2 lit. b GDPR to comply with an appropriate level of data protection.
How long is your Personal Data stored?
If your application for employment is unsuccessful, Hauser & Wirth will hold your Personal Data on file for no longer than 12 months after the end of the relevant recruitment process. At the end of that period your Personal Data will be deleted.
In the event that you have agreed to further storage of your Personal Data, we will transfer your Personal Data to our applicant pool. There the Personal Data will be deleted after two years.
In accordance with Art. 15 GDPR, you are entitled to obtain access at any time to any Personal Data of yours that are being stored by us. In particular, you may request information about any of following matters: the processing purposes involved; the categories of data regarding you being stored; the categories of recipients of such data; the planned storage period; the existence of a right to demand rectification, erasure, restriction of processing or a right to object; the existence of a right to lodge a complaint with a supervisory authority; the origin of your Personal Data, insofar as they were not obtained from you; as well as the existence of an automated decision-making process, including profiling; you also have the right to request explanatory details.
In addition, you can demand the rectification of incorrect data pursuant to Art. 16 GDPR, as well as the erasure of Personal Data pursuant to Art. 17 GDPR insofar as their processing is not required to exercise the right of freedom of expression and information, to fulfill a statutory obligation, to serve the public interest, or to assert, enforce or defend legal claims.
You furthermore have the right, pursuant to Art. 18 GDPR, to demand that a block or restriction be placed on the processing of the Personal Data concerning you insofar as: their correctness is disputed by you; the processing is unlawful but you object to the erasure of the data; we no longer require the data but you still require it in order to assert, enforce or defend legal claims; or you have expressly objected against the data being processed pursuant to Art. 21 GDPR.
Furthermore, you are entitled pursuant to Art. 20 GDPR to obtain the Personal Data you have provided to us in a structured, commonly used, and machine-readable format, or to demand that such data be transmitted to some other authorized party.
Finally, insofar as the Personal Data concerning you are being processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f) GDPR, you have the right, pursuant to Art. 21 GDPR, to at any time object to having the Personal Data concerning you processed, on grounds relating to your particular situation or insofar as your objection specifically refers to processing for purposes of direct advertising. In the latter case, you will enjoy a fundamental right to object that will be honored by Hauser & Wirth without your having to state grounds in connection with a particular personal situation.
If you believe that our processing of the Personal Data concerning you is not consistent with applicable law, you may lodge a complaint with a competent supervisory authority pursuant to Art. 77 GDPR.
If the processing of your data is based on a declaration of consent you have granted pursuant to Art. 6 para. 1 sentence 1 lit. a) GDPR, you have the right to any time withdraw said consent with effect for the future.

What if you do not provide personal data?
You are under no statutory or contractual obligation to provide data to Hauser & Wirth during the recruitment process. However, if you do not provide the information, Hauser & Wirth may not be able to process your application properly or at all.
